    • HVAC: Heating, Ventilation, and Air Conditioning services
    • Customer: Individual(s) who own or manage the property (professional property managers)
    • Property Managers: Companies that are contracted to manager and maintain rental or lease property and who have been give legal rights to conduct such business on behalf of the owner.
    • Renters: Renters or leasors are not able to contract for services without prior approval, in writing, from the property owner.  In this Privacy/Policy document, the use of the word "renter" is implied to mean "renter", "rentee", or person "leasing" property.
    • Vendors: Companies from which Chastain Heating & Air, Inc., obtains repair parts, materials such as refrigerant, and/or HVAC equipment.
    • Third Party Contractors: This refers to people or sub-contractors that we may obtain to assist in completing a HVAC repair or installation.
    • We/us: Refers to the employees and management of the Chastain Heating & Air, Inc., company.
    • You or I: These terms will be implied to refer to the customer who has contracted with our company to perform a specific HVAC repair or installation.
    • Company: Chastain Heating & Air, Inc.
    • Agreed: This refers to the agreement between the customer and our company to perform a specific type of work.

SECTION 1 ‐ AGE RESTRICTIONS ON ACCESS AND PURCHASES
  1. You must be at least 18 years old to arrange for servicing or installation of HVAC systems. You must be the owner of the property for which service is requested. Renters (including people who lease) must contact their property owner or property managers to arrange for service. You must be of legal age required by the state of Alabama to arrange for HVAC service or system installation. It is your responsibility to know whether you are legally able to schedule our services or equipment installation.


SECTION 2 ‐ WHAT INFORMATION DO WE GATHER AND WHAT DO WE DO WITH IT
  1. When you arrange for HVAC system servicing or equipment installation we collect the following personal information:  
    • Full name
    • Billing Address
    • Job site Address
    • Contact email (owner or property manager)
    • Cell Phone and Home Phone
      (if available)(owner or property manager). We may ask for additional contact numbers if the main cell phone or home phone is not available.
    • Brief description of problem or installation request

  2. What other information we collect and retain:
    • Completed tech notes regarding servicing or installation
    • Invoice information including your personal information listed above, tech notes, and service and equipment installed charges.

  3. How we use your information:
    • We record this information in our company Google calendar for scheduling purposes.
    • We also record this information in our company database for tracking, billing, and analytical work.
    • This information is available to all of our technicians who may be asked to participate in the repair or installation; managers of the company for administrative purposes such as scheduling and billing; and accountants if needed for tax purposes.
    • Your personal information is not provided to other individuals or businesses unless specifically requested by the property owner or manager.
    • We use this information to create an account to schedule service, create billing invoices, record payments, and analyze prior HVAC servicing issues for the customer.  This analysis is used to help recommend future servicing needs to the customer based upon frequency or type of breakdowns.
    • This information is retained in our Company data files permanently.  It is never sold nor released to third party individuals or companies.
    • Renter phone numbers and names are collected soley for the purpose of contacting the renter to ensure that they are home to allow us or one of our third-party contractors to have access to repair or install the HVAC equipment.
    • We do not use cookies, web beacons or other tracking or intrusive tools.
    • We will use the contact email address or phone number to contact the owner or property manager regarding recommended servicing, changes in schedule, equipment issues, or billing issues.  Invoices will be prepared and emailed to the contact email address.
    • We do not sell or release any customer/owner/property manager/rentor information with the exception as necessary to assist the customer in equipment installation financing or other actions as specifically authorized and requested by the customer.


SECTION 3 ‐ CONSENT
  1. How do You provide consent:  
    • By providing us (Chastain Heating & Air) with personal information to schedule HVAC service or equipment installation you are consenting to our collecting and using your information (your credit card information is discussed in Section 4 below).


  2. Can You withdraw your consent:  
    • Due to legal requirements, once an account is created for a customer or vendor, that account and its associated information can not be deleted.  This is a legal requirement necessary to complete all company accounting and tax filing requirements and to retain supporting documentation.  This restriction applies to information in our company job scheduling calendar and any invoices or other data recorded.


SECTION 4 ‐ DISCLOSURE
  1. Sharing Information:   We do not share your personal information with third parties without your consent other than with the following:

    • Third Party Service Providers: With third parties who work on our behalf, provided that such third parties provide at least the same level of privacy protection as required by this Privacy Policy.  Examples of third party vendors will be sub-contractors who are obtained to make changes to wall boards, flooring, attic, plumbing or electrical required to install or repair your HVAC equipment.

    • Lawful Requests: To comply with laws or to respond to lawful requests and legal process (provided that we will endeavor to notify you at the address you have given us if we have received a lawful request for your information).

    • Protection of Rights and Property: To protect the rights and property of our web site and business, our agents, customers and others including to enforce our agreements, policies and terms included in this Privacy Policy or our Terms of Service.

    • Emergency Release of Data: In an emergency, including to protect the personal safety of any person or Corporate Restructuring, Chastain Heating & Air may relase personal data:

  1. Payments:  
    • You may pay for services, repairs, or installation by check, cash, credit card, wire transfers, or ACH payments.
    • If you provide us with your credit card information, the information is transmitted to applicable credit card processors xxxxxxxxxxxx our server using secure socket layer technology (SSL) which employs the AES-256 encryption standard and is not retained in our system.
    • Copies of checks and confirmation of cash is retained by our company and attached to copies of invoices you have paid and retained by our company for tax and accountability purposes.


SECTION 6 ‐ THIRD-PARTY SERVICES
  1. Use of Third Party Contractors:  Chastain Heating & Air, will only acquire third-party services/sub-contractors as needed to complete repairs or installation of your HVAC equipment.  All such third-party contractors are bound by our terms of service and privacy requirements as agreed upon between the customer and our company when service is requested.

  2. Responsibility: We are not responsible for the privacy practices of Services or sub-contractors acquired by the customer and encourage you to read their privacy policies.


SECTION 7 ‐ SECURITY
  1. Personal Information Protection:   To protect your personal information, we take reasonable precautions and follow generally accepted industry practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

  2. Security of Information:   The security of your Personal Information is important to us, but remember that no method of transmission over the internet, or method of electronic storage is 100% secure.  While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

  3. Links To External Sites:   Our Service may contain links to external sites that are not operated by us.  If you click on a third party link, you will be directed to that third party’s site.  We strongly advise you to review the Privacy Policy and terms and conditions of every site you visit.

All requests for service or installation must be made by the customer on record as the account holder or, upon written/email requests, other members of your family authorized to schedule services and who you authorize to obligate payment for such service.  This representation also refers to property managers who are legally contracted to maintain the residence.

  2. Authorizations:  This may also include providing written authorization for property managers to conduct HVAC repairs or installation on your behalf


SECTION 9 ‐ U.S. LAW APPLIES
  1. This site is intended for users located in the United States.  No requests for HVAC service or stallation will be accepted for homes and businesses outside of the Montgomery Alabama county and surrounding areas.
